Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Caskwire website, Discord community, bots, alerts, AI features, and related services (collectively, the "Service"), operated by Caskwire ("Caskwire," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 21 years of age, or the legal drinking age in your jurisdiction if higher, to use the Service. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

Caskwire is an independent information and community service. We monitor publicly available retailer listings and inventory signals, track public label-approval filings, aggregate publicly available whiskey news, surface fair-market and auction pricing information, and provide community features and AI-assisted tools. The Service is informational and community-oriented only. We do not sell, ship, broker, or facilitate the sale or transfer of alcohol or any other product.

Caskwire is not affiliated with, endorsed by, sponsored by, or partnered with any retailer, distillery, brand, marketplace, or platform referenced through the Service. All product names, brand names, logos, and trademarks are the property of their respective owners and are used solely for identification, reference, and descriptive (nominative) purposes. Nothing in the Service should be interpreted as implying any affiliation, sponsorship, or endorsement.

The Service surfaces signals to help you act quickly, but we do not guarantee availability, pricing, stock levels, the ability to purchase, delivery, or any other outcome. Inventory, pricing, and valuation data is gathered from third-party sources, may be delayed, incomplete, or inaccurate, and may change at any time without notice. You are responsible for verifying all information independently before acting.

Fair-price, valuation, and auction information, and any AI-generated output, is provided for general informational purposes only and does not constitute financial, investment, appraisal, tax, or legal advice. Whiskey is not offered or represented as an investment. We make no representation or warranty regarding resale value, returns, or future pricing. You assume full responsibility for any decision you make.

The Service includes AI-assisted features that generate automated responses. These responses may be incomplete, outdated, or incorrect, and should not be relied upon for purchasing, valuation, financial, health, or legal decisions without independent verification. You use AI features at your own risk.

Certain features require a paid membership. Pricing, including any founding-member rate, is described at the point of sale and may change for future members. Paid memberships renew automatically on a recurring basis until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable. We may add, modify, suspend, or discontinue features at any time.

You agree not to use the Service to:

(a) violate any law or regulation, including laws governing the purchase, transport, sale, or resale of alcoholic beverages; (b) resell, redistribute, scrape, or share alerts, data, AI output, or member access without our written permission; (c) interfere with, overload, or attempt to gain unauthorized access to the Service; or (d) use the Service for any unlawful, harmful, or abusive purpose. You are solely responsible for your conduct and for complying with all applicable laws in your jurisdiction.

The Service may reference or link to third-party websites, retailers, marketplaces, and services (including Discord and payment processors). We do not control and are not responsible for third-party sites, content, data accuracy, availability, or practices. Your use of third-party services is governed by their own terms.

The Service, including its design, text, graphics, logos, software, and original content, is owned by Caskwire and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not copy, reproduce, or create derivative works without our written permission.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION IS ACCURATE OR COMPLETE.

TO THE FULLEST EXTENT PERMITTED BY LAW, CASKWIRE AND ITS OPERATORS, OWNERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR RELIANCE ON ANY INFORMATION PROVIDED. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Caskwire and its operators from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

These Terms are governed by the laws of the State of [YOUR STATE], without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved through binding individual arbitration, and you and Caskwire waive the right to a jury trial and to participate in a class action, to the extent permitted by law.

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
